Privacy Notice

United States Artists respects your privacy. This Privacy Notice (“Notice”) for United States Artists ("we," "us," or "our"), describes how we collect, use, and disclose your personal information when you access or use our website unitedstatesartists.org (“Site”). 1. What information do we collect?

We may collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you (“Personal Information”) when you use our Site. The Personal Information we collect falls into three categories: (1) Personal Information you disclose to us, (2) information we collect through automated methods, and (3) Personal Information we collect from third parties, each further detailed below. 

Personal information you disclose to us

We collect Personal Information that you voluntarily provide to us, including when you express an interest in obtaining information about us or our services or programs, make a donation, apply for a job, or otherwise when you contact us. This may include your email address, name, phone number, and mailing address. This also may include information contained in your resume or job application materials if you choose to apply for a job with us. When you make a donation, you will be required to submit your contact and billing information. Payment information is sent directly to the applicable payment provider who processes your donation. We do not record or store payment information, but we may keep a record of your donation and contact information (including your name and donation amount).

Information automatically collected

We may use cookies, web beacons, pixels, and similar tracking technologies (collectively “Tracking Technologies”) to gather information when you interact with our Site. The information we collect using Tracking Technologies includes:

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Site and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Site (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).

  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Site. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

  • Google Analytics. We use Google Analytics to collect and process information about your use of the Site. Google sets Tracking Technologies on your browser or device, and then your web browser will automatically send information to Google. Google uses this information to provide us with reports that we use to better understand and measure how users interact with our Site. Most web browsers are set to accept Tracking Technologies by default. If you prefer, you can usually choose to set your browser to reject certain Tracking Technologies. You also may reject certain Tracking Technologies by using the cookie banner on our Site. Doing so could affect certain features of our Site.

Information from third parties 

We collect Personal Information from third parties, including other nonprofits organizations, when we partner or collaborate with them to provide programs, services, and events.

2. How we use your Personal Information 

We use Personal Information that we collect for the following purposes: 

  • As Stated or Agreed to at the Point of Collection. We may use Personal Information for the purposes stated or agreed-to (or as is obvious) at the point of collection. For example, we may use your Personal Information to: (i) process and respond to your questions, comments, or complaints; and (ii) process and complete donations. We may also use your Personal Information as otherwise requested or consented to by you.

  • Administration. We use Personal Information for administrative purposes, such as for complying with internal audit requirements, managing risks, obtaining professional advice, and understanding the Site’s demographics and user preferences.

  • Site Management. We use Personal Information for Site management, such as troubleshooting problems, improving the content and functionality of the Site, statistical and other analyses of the Site, and customizing the Site to you and our other users.

  • Business Analytics. We use Personal Information for business analytics purposes, including consumer and operations research and to assess the effectiveness of our Site.

  • Advertising and Other Communications. We may use Personal Information to send you our newsletter, to notify you of new features on our Site or new services, to notify you of changes to our website terms or this Notice, and for other similar communications. We may use third parties or service providers to deliver communications to you. You may opt-out marketing emails by using the unsubscribe link contained in such emails. 

  • Job Applications: We use Personal Information submitted in the application for purposes of filling the position for which you have applied. 

  • To Protect Our Rights. We may use Personal Information to protect our legal rights or interests, or those of other parties, including to bring a legal action against you or anyone who may be causing harm to us, our Site, or to other users of the Site. We may also use Personal Information to seek business, financial or legal advice, and to respond to other legal requests. 

  • Create Aggregated and De-Identified Data. We may process Personal Information to create deidentified and aggregated data. Any such deidentified and aggregated data is no longer subject to this Privacy Notice.

3. How long we keep your information

We will keep Personal Information for the period necessary to fulfill the purposes described in this Notice, unless a longer retention period is permitted or required by law. We take reasonable steps to delete the Personal Information we collect when: (1) we have a legal obligation to do so, (2) we no longer have a purpose for retaining the information, or (3) if you ask us to delete your Personal Information, unless we determine that doing so would violate our existing legal, regulatory, dispute resolution, contractual, or similar obligations. We may also decide to delete your Personal Information if we believe it is incomplete, inaccurate, or that our continued storage of your Personal Information is contrary to our legal obligations or business objectives. When we delete your Personal Information, it will be removed from our active servers and databases; however, it may remain in our archives when it is not practical or possible to delete it. 

4. How we keep your information safe 

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any Personal Information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of Personal Information to and from our Site is at your own risk. You should only access the Site within a secure environment.

5. Will your information be disclosed?

We may disclose your Personal Information to the following third parties: 

  • Affiliates and Third Parties. We may disclose Personal Information to our affiliates and with their respective officers, directors, employees, and agents for our business purposes. We also may disclose Personal Information to other third parties, such as other nonprofit organizations, who we partner and collaborate with to provide programs, services, and events. 

  • Vendors and Service Providers. We may disclose Personal Information to vendors and service providers that provide services for us. For example, we may disclose Personal Information to third parties that help us host and manage the Site, provide advertising and marketing, improve the content and functionality of the Site, and support or provide the security of the Site. 

  • Government Officials / Law Enforcement. We will cooperate with law enforcement and other governmental agencies, and may disclose Personal Information: (i) if we believe in good faith we are legally required to disclose that Personal Information, (ii) if we are advised to disclose Personal Information by our legal counsel, (iii) when necessary to identify, contact or bring a legal action against someone who may cause or be causing harm to, or interfering with the legal rights of, United States Artists or any other party, or (iv) as otherwise appropriate.

  • Professional Advisors. We may disclose Personal Information to our professional advisors, such as our attorneys, accountants, financial advisors and business advisors, in their capacity as advisors to United States Artists. 

  • Subsequent Owner or Operator. We may disclose your Personal Information to a successor entity or an operator upon a merger, consolidation, acquisition, bankruptcy, dissolution, liquidation or other corporate reorganization or discussions related to the same, to a purchaser or potential purchaser of all or a portion of our assets, or pursuant to a financing arrangement or co-promotional agreement. The Personal Information we have about you may be transferred to parties to the transaction.

  • Other. We may disclose Personal Information to third parties when explicitly requested by or consented to by you, or for the purposes for which you disclosed the Personal Information to us as indicated at the time and point of the disclosure (or as was obvious at the time and point of disclosure).

6. Children’s information

We do not knowingly collect, solicit data from, or market to children under 18 years of age or the equivalent age as specified by law in your jurisdiction, nor do we knowingly sell such Personal Information. By using the Site, you represent that you are at least 18 or the equivalent age as specified by law in your jurisdiction or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Site. If we learn that personal information from users less than 18 years of age or the equivalent age as specified by law in your jurisdiction has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 7. Third-party websites

The Site may link to, or be linked from, websites not controlled by us. We are not responsible for third parties’ privacy policies or practices. This Notice does not apply to any third-party websites or to any data that you provide to third parties. You should read the privacy policy for each website that you visit.

8. Access from outside the United States 

The Site is intended for use in the United States. If you access the Site from outside the United States, please be aware that Personal Information may be transferred to, stored in, and processed in the United States, which may have different data protection laws than the country/region where you reside or are a citizen. 

9. Do we make updates to this notice?

We may update this Privacy Notice from time to time. The updated version will be indicated by the “Last Updated” date at the top of this Privacy Notice. If we make material changes to this Privacy Notice, we may notify you either by prominently posting a notice of such changes on the Site or by otherwise sending you a notification.
